Data Collection

1. A&I Education primarily collects and keeps your personal data in the following circumstances:-
   • When you take part in any exercises, tests, surveys or games on our website;
   • When you submit any work (such as articles and other art work) or make any statements; and
   • When you register to take part in any activities organized by A&I Education.
2. Under general circumstances, A&I Education will not sell, trade or disclose any information or personal data you provided to us to any third party without your prior consent or notice to you. Only authorized staff of A&I Education has access to your personal information for administrative purposes without your authorization or notice to you.
3. Under special circumstances, A&I Education shall have the right to disclose or release your personal data to any third party without your prior consent or notice to you. The said special circumstances include the protection of the rights, interests, copyright and intellectual property rights of A&I Education and its users, and the investigation or inquiry of illegal activities and any procedures required by law and the protection of the personal safety of the users and general public, etc.
4. A&I Education reserves the right to use the personal data you provided for statistical and data analysis and may collect personal data and order details provided by users of and reserves the right to use the results derived from the statistical analysis of such information, which shall not include any personally identifiable information. A&I Education is the owner and proprietor of the results generated from such statistical analysis and reserves the right to announce, use and publish the same.

Data Security

1. Every registered user is provided with a private password and access to personal data stored on the A&I Education’s website is only permitted with the use of password.
2. The A&I Education system ensures that access to personal data is only permitted by using such password.
3. A&I Education endeavours to protect the confidentiality of personal data stored in the system of A&I Education but it does not give any warranties or representations of the safety and security of data transmission. In the event that you become aware of any unauthorized disclosure of your personal data, please contact us immediately.
4. You are responsible for maintaining the security of your passwords in your possession and not to reveal your password to any third parties. A&I Education is only responsible for the security of passwords stored within our system.
5. You should avoid storing your password in the computer hard disk, and you must close the browser window immediately after you have logged out in order to prevent others from accessing your personal data.

Domain Names and IP Addresses

Every time you log on to the A&I Education website, our network servers will automatically verify your domain name and IP address and A&I Education will use such data for visitor flow statistical and data analysis.

1. When you log on to A&I Education, A&I Education will record the relevant data containing your browsing preferences (i.e. 'cookies') through your browser to your computer hard disk, so that the site will be displayed according to the users’ usual way of use on subsequent visits.

   Any content posted, uploaded or otherwise caused to be placed on the Site otherwise than by A&I Education shall be subject to a non-exclusive licence granted in favour of A&I Education for its use, manipulation or display in whole or in part by A&I Education in the operation of the Site.
   
   You are solely responsible for complying with all applicable laws and securing all necessary consents in providing and securing the provision of such licence in the absence of which you shall indemnify and keep indemnify A&I Education for losses resultant from such failure.

3. The trademarks appearing on this A&I Education’s website are protected by the laws of Hong Kong and by international trademark laws.

A&I Education does not make any warranty that use of the Website will be uninterrupted, virus-free or error-free; or that use of the A&I Education’s website will not affect other software or operating systems used to access A&I Education’s website. Any warranties provided under the general law are expressly excluded to the fullest extent possible. In particular, A&I Education does not warrant that use of its website will not infringe the rights of any other person or organisation; nor that its website is of reasonable quality or fit for any particular purpose, even if A&I Education has received notice of an intention to use its website for that purpose.

You expressly acknowledge and agree that A&I Education shall not be liable for any direct, indirect, incidental, special, consequential or exemplary or punitive damages, including but not limited to, unauthorized access to or alteration of your transmissions or data; (4) statements or conduct of any third party as a result of service provided by A&I Education or (4) any other matter relating to the service of A&I Education.

We welcome you for accessing, browsing the webpages of the A&I Education website (http://wels.welnet.hk), hereinafter “A&I Education”) . By accessing and browsing the A&I Education website (together, the “Users”), you have agreed to at all times abide by these terms and conditions of use (the “Terms”).

1. Provision of Information, Password and Security

1.1   You agree to : -

a.   provide on all online and offline registration forms and other documents submitted to A&I Education all required information and such information must be accurate, up-to-date and complete;

b.   maintain and update all information submitted to A&I Education from time to time, so as to keep them accurate, up-to-date and complete.

1.2   All access to, browsing of, registrations with or accounts under A&I Education and other related privileges are liable to be terminated, for reasons of inactivity, breaching any of the Terms or otherwise, at our sole discretion without any liability or recourse, with or without notice, to you.

1.3   You shall keep all password and other login information related to your account or other registration at A&I Education strictly confidential and be responsible for their security. You agree to inform us immediately if such password or information has been used or accessed without your authorization. We reserve the right to take all actions in securing the safety and integrity of A&I Education as we deem appropriate, including without limitation monitoring, recording internet activities, internet protocol addresses, verifying user information, tracing and tracking information flow.

2. Intellectual Property Rights

2.1   You agree to comply with all intellectual property laws (the “IP Laws”) of the Hong Kong Special Administrative Region of the People’s Republic of China ( the “ HKSAR ” ).

2.2   You agree not to conduct any activity not in compliance with the IP Laws, or infringe or cause to be infringed any intellectual property right and/or other proprietary right of any material on the website of A&I Education , and you agree not to link any part of the A&I Education website to any website which may conduct such infringing activities. Such infringing activities include, for instance: -

-   Infringement of copyrights, trademarks, patents or other intellectual or proprietary rights of any party (the “IP Rights”);

-   Breach of any security measure for protection of IP Rights , including falsifying serial numbers or registration codes or use of hackers’ tools;

-   Copy, reproduce or exploit in any way contents of websites without prior authorization or consent;

-   Supply pirated files or links to such files.

2.3   If a User is found conducting activities infringing IP Rights, we may without liability or recourse to you, with or without notice:

-   Remove any posting, content or material which we consider infringing, in relation to the IP Laws, IP Rights or otherwise, or in breach of the Terms;

-   Terminate the relevant registration or account of the User and may consider taking appropriate legal actions.

3. Storage and content requirements

3.1   All Users agree and accept that any webspace or storage capacity (the “Storage”) provided by or through A&I Education is subject strictly to its first right of use.

3.2   All Users agree and accept not (and that they have no right) to sell, transfer, assign, part or otherwise share with or allow the usage by others whole or part of the Storage except with our express consent. No User may derive or receive any commercial benefit, which we consider in our sole discretion to be material, by any means arising directly or indirectly from or in connection with the use or exploitation of the Storage or the A&I Education website in general.

3.3   No User may upload, post or disseminate any content or information which is in violation or breach of any law, legislation or regulation currently in force in Hong Kong (the “Public Dissemeniation Laws”) at the A&I Education website (including but not limited to the Reading Room, Study Room, Playground, Bulletin Board, Achievement, Private Message, StoryTelling etc. ), such contents or information include but are not limited to: -

-   any programs or files which contain computer viruses;

-   statements or information which may be discriminatory on the basis of gender, age, sexual orientation, race, culture, religion, socio-economic status or otherwise;

-   contents which are prejudicial, malicious, abusive or portray any one or any organization in a demeaning light, or are generally profane;

-   contents which are pornographic or contain obscene images or material, or are otherwise contrary to the Control of Obscene and Indecent Articles Ordinance (Cap. 390 of the Laws of Hong Kong);

-   supply information for or procure any activity which are illegal, or adversely affecting any person or the public, including but not limited to: -

• providing computer virus software or the method of designing or writing computer virus;
• providing the method of illegal entry, the deletion of homepage or the homepage of network provider's;
• providing methods to de-code or crack the copyright protective device set up by the manufacturer, including software serial number or registration number;
• providing method of transmission of “Spam” emails or providing any softwares to the public for cracking softwares;
• providing pirated music, pirated software or links to the related websites;
• malicious spreading or dissemination of other’s privacy, and requesting passwords from other citizens or iHouse user;
• setting up "Crush” websites;
• falsely representing or holding out to be the staff of A&I Education, or attempting to cause others to falsely assume the identity of the sender or the source of message or information.

3.4   If a User is found to be in breach of the Public Dissemination Laws , we may without liability or recourse to you, with or without notice : -

-   Remove any posting, content or material which we consider infringing, in relation to the Public Dissemination or otherwise, or in breach of the Terms;

-   Terminate the relevant registration or account of the User and may consider taking appropriate legal actions.

4. Prohibition on Transactions

4.1   No User shall conduct on or utilize any part of the A&I Education website for the conduct of transactions of commercial or any other nature with our express prior consent in writing.

4.2   Any transaction so authorized by us to be engaged pursuant to the preceding clause shall at all times be in compliance with these Terms and the specify terms and conditions attached to our relevant contract, agreement or authorization.

5. Others

5.1   A&I Education reserves the right to amend these Terms without any prior notice.
